What to Expect
Guest Speaker: Eli Ben-Shmuel
Sentencing for crime seems out-of-control. Well, is it?
And if so, why? U.S. Attorney Eli Ben-Shmuel will clarify the issue from the federal perspective.
Individuals convicted of federal crimes used to know exactly how much time they would spend in custody, with most serving approximately 85% of the sentence imposed by the court. The First Step Act of 2018 is the most significant change to federal sentencing and correctional law since 1996. The law makes significant changes to the way in which federal sentences are computed and will lead to a significant increase in the number of individuals spending less time in prison and more time in the community. This is an introduction to the First Step Act and the basics of the changes it has made.
Eliezer Ben-Shmuel is the Supervisory Attorney of the Consolidated Legal Center -- Federal Prisons -- in Los Angeles, a position he’s held since January, 2004. Mr. Ben-Shmuel and his staff provide advice and representation to staff in the Bureau’s facilities in the Central District of California. Mr. Ben-Shmuel has also been a Special Assistant United States Attorney with the U.S. Attorney’s Office’s Civil Division since 2006, directly representing the Bureau and its employees in habeas proceedings, civil actions and appeals. Before this current position, his practice consisted mainly of civil litigation, with an emphasis on employment litigation defense. Mr. Ben-Shmuel received his Bachelor’s Degree in Political Science from the University of California, Los Angeles and his law degree from the University of California, College of the Law, San Francisco (formerly UC Hastings College of the Law).
